The Yoga Agency: Terms & Conditions
1.1 “Company” refers to The Yoga Agency (TYA).
1.2 “Customer” refers to the client, or company who has booked The Yoga Agency services.
1.3 “Teacher” refers to the person or persons responsible for overseeing and teaching any classes booked.
1.3 “Class” or “Classes” refer to The Company’s corporate wellbeing classes, including yoga, pilates, meditation, Reiki, massages, HIIT and any other wellbeing activities as agreed with the client.
1.5 “Terms and conditions” refer to this document.
1.6 If you access and use this website (the “Site”), you accept and agree to be bound by and comply with these terms (the “Terms”). If you do not accept the Terms, you should not use the site.
1.7 The Company reserves the right to change the Terms and therefore asks customers to check the Terms regularly, prior to booking.
2. Booking & Payment terms
2.1 Customers are required to pay for corporate bookings within 10 days of invoice receipt either on a rolling monthly basis, or for the agreed number of sessions.
2.2 Prices are agreed prior to the first session, these may change from time to time, but all bookings made prior to change in price will remain unchanged.
2.3 Teachers will be paid on the last day of every month for any classes that took place within that month.
3. Cancellations (Customer)
3.1 Private and corporate classes operate a 48 hour cancellation policy. Where cancellations are made in sufficient time, credit will be added back to the relevant account, or a paid for class will be ‘rolled over’ to another week. Classes cancelled with less than 48 hours notice will still incur the full fee.
3.2 The Company cannot be held responsible for an instructor becoming unavailable. If a teacher becomes unavailable we will ensure – where practically possible – that they are replaced by another teacher. Where this is not possible, or where a session is cancelled due to unforeseen circumstances, we will issue a credit note to all those who have previously booked that Class. The Company will not be liable for any other incurred costs or damages to the customers from a cancellation.
4. Locations and Start Times
4.1 Customers and teachers are asked to arrive at least 5 minutes prior to the start of the Class. The Company reserves the right to refuse entry to anyone arriving after the start of the Class.
4.2 For corporate and private bookings, the location must be agreed between the Company and the Customer five days prior to the first class and it is the responsibility of the Customer to ensure the location is safe and suitable for a wellbeing class.
5. Client/Customer and Teacher protocol
5.1 Corporate and private bookings are an arrangement between the Company and the Customer. All class bookings, cancellations and arrangements are to be made between the Company and the Customer (with the teacher keeping informed throughout). Booking or attempting to book a Yoga Agency teacher independently and not through the Company will result in an immediate termination of the teacher’s contract and other bookings with the Company.
5.2 Following the termination of a corporate or private contract, the former Yoga Agency teacher is not permitted to teach the Customer for 6 months after the date of the final class. If the former teacher continues to teach the Customer within the 6 month period after the final class, the Customer will be obligated to reimburse the Company for the full amount paid to the teacher for these classes.
5.3 The teacher is only paid once payment has been received from the customer and TYA accepts no liability in eventing non-payment by customer.
6. Fitness and Health
6.1 The Company advises Customers not to take part in one of the Classes without first seeking medical advice if they have any concerns at all over their physical condition.
6.2 Customers with low or high blood pressure or cardiovascular irregularities should not attend the Class without express and written permission from a medical professional.
6.2 The Company reserves the right to refuse access to any Customer if it in any way doubts the health of the Customer and their ability to safely take part in the Classes.
6.3 Customers accept the risk of injury from performing exercises in the Classes. The Company accepts no liability for injury to the Customer, except in so far as such injury is by law incapable of exclusion.
6.4 Women who are 14+ weeks pregnant are welcome to join the class, on the basis that they have some prior yoga experience. We regret that pregnant women less than 12 weeks and with no prior yoga experience are not recommend to join the class. Pregnant women are asked to complete a pregnancy yoga or pregnancy Pilates class prior to practicing.
7. Dress and Suitability
7.1 The Company request all Customers to dress appropriately for yoga and Pilates class.
7.2 Cleanliness and hygiene is essential – both of Customers themselves and their attire.
7.3 Children under the age of 16 should not attend Classes without the supervision of a responsible adult.
7.4 Shoes should not be worn during the (Yoga and Pilates) Class.
7.5 Corporate and private yoga Customers will need to provide their own yoga mats (with the help of the Company)
